Gorsuch’s First Ruling Just Made Trump Smile Ear To Ear
Justice Neil Gorsuch stayed true to his word on Monday, with a unanimous decision for his
first Supreme Court opinion.
Gorsuch was the author of a ruling in favor of a company involved in a debt collection
dispute.
The court ruled that Santander Consumer USA – a company who purchased defaulted car
loans with the intention to collect – does NOT fall under a federal law aimed at unscrupulous
debt collectors.
“Disruptive dinnertime calls, downright deceit and more besides drew Congress’ eye
to the debt collection industry,” Gorsuch began, quickly framing the issue to focus
on whether the company can be called a “debt collector” by law.
“Everyone agrees that the term embraces the repo man — someone hired by a creditor
to collect an outstanding debt.
But what if you purchase a debt and then try to collect it for yourself — does that make
you a ‘debt collector’ too?”
Gorsuch continued.
“Santander does not qualify as a debt collector because it purchased the loans in question
and was not trying to collect on someone else’s behalf.’
In the end, Gorsuch proved even further why he was the right choice, focusing solely on
the law how it’s written.
“[Courts] apply, not amend, the work of the people’s representatives,” Gorsuch
finished.
It’s this brand of forward-thinking honesty that earned Justice Gorsuch his seat, and
if this is any indication of the future, President Trump will continue to appoint those who believe
in the laws of this country.
